Terms of Sale
These are the terms we sell on. They are short on purpose: what we quote, when we start, when you pay, what we owe you if a part is wrong, and which law applies.
The instant quote on this site is an indication, not an offer, and is not capable of acceptance — see Quotations. The price we send you in writing after an engineer has reviewed the model is the one that binds us.
Who these terms are between
LASEM is the brand name of an independent manufacturing business based in Guangzhou, Guangdong, China, supplying on-demand 3D printing and related engineering services worldwide. In these terms, "we" and "us" mean that business, and "you" means the customer placing an order.
These terms apply to every order we accept, unless we have signed a written agreement with you that says something different. If you send us your own purchase terms and we do not sign them, these terms still apply to the order.
Quotations
The instant quote on this website is an indication, not an offer, and is not capable of acceptance. It is calculated in your browser from the geometry of your file and from published market rates, and it does not bind either of us.
A quotation becomes binding on us only when we have sent it to you in writing after an engineer has reviewed the model. Written quotations are valid for 30 days from their date, except quotations for metal powder, which are valid for 7 days because the metal price moves.
Prices are in US dollars unless we state otherwise, and are exclusive of freight, insurance, import duties and taxes. The production price does not change once you have approved it in writing. If your file changes, we re-quote.
When an order exists
An order exists when we have confirmed it in writing and received the deposit described below. Neither an upload, nor an instant quote, nor an email exchange before that point obliges us to produce anything.
We may decline any order. If we cannot produce your part as drawn we will tell you before we accept the order rather than after.
Payment
50% of the order value is payable as a deposit before production starts. The remaining 50% is payable before the goods are dispatched.
We do not dispatch before the balance has cleared, and we do not request the balance before the inspection photographs have been sent to you.
Payment is by bank transfer (T/T) to our company account. For small orders we may accept Wise or PayPal on request; where we do, the fees charged by those platforms are added at cost. Bank charges and intermediary bank charges on a transfer are for the payer's account.
We do not ask for card details on this website and we will never ask for them by email. If you receive a message claiming to be us and requesting card or bank details, do not act on it — contact us on the address published on this site.
Inspection before dispatch
We photograph every job after inspection and send the photographs to you. On request we will arrange a live video walkthrough of your parts before the balance is paid, so that you can see them and have critical dimensions measured while you watch.
If your quality system requires third-party inspection, tell us which inspection body and we will make the goods available to them at the appropriate point in the process.
If we find something marginal or out of specification during inspection, we will tell you and show you before dispatch.
Lead time
Lead time runs from the later of two events: our receipt of the deposit, and our receipt of your final written approval of the file to be produced. It does not run from the date of your first enquiry.
Quoted lead times are production time in our facility. Transit time, customs clearance and any delay caused by an incomplete or inaccurate address or by import formalities are additional and are not within our control.
We will tell you as soon as we know if a lead time is at risk, and why.
Delivery, risk and duties
Boxed parts are shipped by express courier (DHL, FedEx or UPS) on DAP terms: we deliver to the address you give us, and import duties and taxes are payable by you, collected by the carrier before delivery. We can quote DDP on request.
Pallets, powder orders and oversized consignments are priced EXW Guangzhou, with freight arranged by the forwarder of your choice or, if you prefer, by one of ours. Risk passes in accordance with the Incoterm quoted on the order.
You are the importer of record and are responsible for import licensing, duties, taxes and clearance in the destination country. Some destinations require an export licence for metal powders; the export eligibility list on this site sets out what we have confirmed to date.
Changes and cancellation
Before production starts, you may change the file or cancel the order. We refund the deposit less any cost we have already incurred — typically the engineering review and any material already ordered.
After production has started, the deposit is not refundable, because the machine time and the material are already committed and cannot be resold. If the order has not yet been dispatched we will still send you the parts once the balance is settled.
Changes after production has started are re-quoted, and any additional cost or delay is agreed with you before we proceed.
Tolerances and acceptance
Parts are produced to the dimensions and tolerances on the drawing or model you approve. Dimensions you do not annotate are held to the standard we hold for that process, which is not the same number on every geometry.
Where a drawing carries no tolerance and no critical dimensions, acceptance is against the geometry of the approved file at the process's usual commercial tolerance, and against normal commercial cosmetic standards for the process — layer lines, support witness marks and minor surface variation are inherent to additive manufacturing and are not defects unless a finish was ordered that removes them.
Colour, gloss and translucency are matched as closely as the process allows and are not guaranteed to a numeric standard unless we have agreed one in writing.
If something is wrong
Tell us within 30 days of delivery, with the measurement or the feature you are unhappy about. We will investigate, and if the part does not match the drawing we agreed, we will reprint it or refund it at our cost.
Our obligation is to repair the position on the affected parts. It does not extend to the cost of the assembly they were due to go into, to lost production, or to any loss that follows from the defect.
This is the whole of our obligation on a defective part, and nothing on this site adds to it. It does not limit any right you have that cannot be limited by agreement under the law that applies.
Limitation of liability
Our total liability arising out of an order, whether in contract, in tort or otherwise, is limited to the amount you have paid us for that order.
We are not liable for indirect or consequential loss of any kind, including loss of profit, loss of production, loss of contract or loss of data.
We are not liable for anything caused by a file that you approved and that we produced as approved, or by a design that is not fit for the purpose you intended.
We hold product liability insurance and will provide evidence of it on request.
Your files, your design
The design and the model files you send us remain yours. We receive them for the purpose of quoting and producing your order. We do not claim any right in them and we do not use them to make anything for anyone else.
We keep your files confidential. We do not tell anyone what you are having made. We will sign your NDA, or provide our own, on request.
You confirm that you hold the rights needed for us to produce the part, and you indemnify us against any claim arising from a design that infringes someone else's rights.
Once an order is closed you may ask us to delete your files, and we will.
Photographs and case studies
We photograph every job as part of our quality record. Those photographs are used for inspection, for the job record, and to show you what is about to ship.
We will not publish photographs of your parts, your name or your project on this site, in a case study, on social media or anywhere else without your written permission first.
If your work is under an NDA, tell us before you send the file, and we will not photograph the parts at all.
Force majeure
We are not liable for delay or failure caused by something outside our reasonable control, including but not limited to power interruption, machine breakdown beyond economic repair, fire, flood, epidemic, war, sanctions, export-control action, a supplier's failure, or a carrier's or customs authority's delay.
If such an event affects an order, we will tell you promptly, and either extend the lead time by the length of the delay or cancel the order and refund what you have paid for goods not yet produced.
Governing law and disputes
These terms and any contract made under them are governed by the laws of the People's Republic of China.
The courts of Guangzhou, Guangdong, China have exclusive jurisdiction over any dispute arising out of or in connection with an order, and both of us submit to that jurisdiction.
Before taking any formal step, we ask you to raise the issue with us directly. Every dispute we have had has ended in a conversation, and the fastest route to a working outcome is usually that one.
Changes to these terms
We may update these terms. The version that applies to an order is the version published on this page on the date we confirm that order in writing.
If we change these terms and the change is material to an order already placed, we will tell you before it takes effect.
